1.1 These Terms and Conditions (“Terms”) govern your access to and use of the StoryMoments platform, including the StoryMoments mobile application, the StoryMoments website, and any related products or services (together, the “Platform”).
1.2 The Platform is operated by Lambda Partnership Ltd, a company incorporated in England and Wales, trading as StoryMoments (“StoryMoments”, “we”, “us”, or “our”).
1.3 These Terms constitute a legally binding agreement between you and StoryMoments. By accessing, browsing, registering for, purchasing from, or using any part of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms.
1.4 If you do not agree to these Terms, you must not use the Platform.
1.5 These Terms apply regardless of whether you use the Platform through the mobile application, the website, or any other access method made available by StoryMoments.
1.6 These Terms take precedence over any marketing materials, promotional content, FAQs, illustrations, examples, or statements made on the Platform or elsewhere, which are provided for informational purposes only and do not form part of this agreement.
1.7 We may update these Terms from time to time. Where required by law, we will provide notice of material changes. Continued use of the Platform after updated Terms take effect constitutes acceptance of the revised Terms.
2.1 In these Terms, capitalised words have the meanings set out below:
2.2 Headings are for convenience only and do not affect interpretation.
2.3 Words in the singular include the plural and vice versa.
2.4 References to legislation include any amendments or replacement legislation in force from time to time.
3.1 The Platform is operated by Lambda Partnership Ltd, trading as StoryMoments.
3.2 StoryMoments is registered in England and Wales.
3.3 Contact details and support channels are made available via the Platform. Formal legal notices must be submitted in writing using the contact details published on the website.
3.4 StoryMoments operates as a consumer-facing digital platform. It is not regulated as a legal, financial, medical, or advisory service.
4.1 You must be at least 18 years old to create an Account or make purchases on the Platform.
4.2 By using the Platform, you confirm that:
(a) you have the legal capacity to enter into a binding contract;
(b) you are using the Platform for personal, non-commercial purposes only; and
(c) all information you provide is accurate and kept up to date.
4.3 You must not use the Platform on behalf of another person unless you have lawful authority to do so.
4.4 You are solely responsible for ensuring that any Content involving third parties, including children or vulnerable individuals, is created, uploaded, and shared lawfully and with all necessary permissions and consents.
4.5 The Platform must not be used to create, store, or deliver suicide notes, self-harm content, or content intended to replace emergency, therapeutic, or crisis support. StoryMoments reserves the right to restrict or remove such content.
5.1 StoryMoments is a digital storytelling and memory-sharing platform designed to allow users to record, store, organise, and share personal stories and messages for loved ones.
5.2 The Platform is intended for use during life, with optional tools that allow users to control access to Content in the future.
5.3 StoryMoments does not act as:
(a) a trustee, executor, custodian, or fiduciary;
(b) a guaranteed delivery service in all circumstances; or
(c) a permanent archival service.
5.4 The Platform, its features, and its functionality may evolve, change, or be discontinued over time. StoryMoments does not guarantee that any specific feature, format, or access method will remain available indefinitely.
5.5 The Platform is provided for personal, non-commercial use only. Commercial use, resale, or exploitation is prohibited unless expressly authorised in writing by StoryMoments.
6.1 StoryMoments is a personal digital storytelling platform only . It does not operate as, and must not be relied upon as:
(a) a will, codicil, trust, letter of wishes, or estate-planning instrument of any kind;
(b) a substitute for professional legal advice, a solicitor, a will-writing service, or any legally binding arrangement;
(c) a medical, therapeutic, counselling, psychiatric, or mental-health service; or
(d) a guaranteed, automated, or legally effective mechanism for the delivery of content after death or incapacity.
6.2 You acknowledge and agree that any Content created, stored, or shared through the Platform:
(a) has no legal force or effect in relation to inheritance, succession, estate distribution, or legal rights; and
(b) does not override, amend, or supplement any will, trust, or legally binding document.
6.3 You accept full responsibility for making all appropriate legal, personal, and practical arrangements outside the Platform, including but not limited to wills, estate planning, powers of attorney, advance directives, and clear instructions to loved ones.
6.4 You expressly acknowledge that:
(a) the Platform is used at your own discretion and risk;
(b) emotional, personal, or relational outcomes are inherently subjective and unpredictable;
(c) Recipients may never access, view, understand, or engage with your Content; and
(d) no statements, illustrations, examples, or marketing materials create any expectation, representation, or assurance as to emotional impact, personal benefit, or recipient behaviour.
6.5 To the fullest extent permitted by law, you confirm that you have not relied on any representation, warranty, statement, or assurance made by or on behalf of StoryMoments when deciding to use the Platform, other than those expressly set out in these Terms.
7.1 To use most Platform features, you must create an Account.
7.2 You are responsible for maintaining the confidentiality of your Account credentials and for all activity carried out through your Account.
7.3 StoryMoments is not responsible for unauthorised access resulting from your failure to safeguard credentials.
7.4 You must promptly notify StoryMoments of any suspected unauthorised access or security breach.
7.5 StoryMoments is under no obligation to recover lost credentials, restore access, or reverse actions taken through an Account.
7.6 Each user may maintain only one Account unless expressly permitted otherwise.
8.1 The Platform allows you to designate one or more individuals as recipients (“Recipients”) of specific Content or collections of Content.
8.2 Recipient access may be provided through invitations, links, notifications, or other access mechanisms determined by StoryMoments from time to time. Recipients are not required to create an Account unless expressly stated.
8.3 Any references to “no passwords” or “no setup” for Recipients describe the intended user experience only and do not constitute a guarantee of access, delivery, or ease of use.
8.4 StoryMoments does not:
(a) verify the identity of Recipients;
(b) monitor whether Recipients receive, open, or view Content; or
(c) ensure that Recipients understand, accept, or engage with Content.
8.5 You are solely responsible for ensuring that Recipient details are accurate and kept up to date. StoryMoments is not responsible for failed or delayed access caused by incorrect, outdated, or incomplete Recipient information.
8.6 Recipient access may be provided through links, notifications, deep-linking mechanisms, or similar access technologies. Such access relies on third-party technologies, software development kits (SDKs), platforms, devices, operating systems, networks, and app marketplace functionality that are not operated or controlled by StoryMoments. StoryMoments does not guarantee uninterrupted, timely, secure, or error-free access to Content via such mechanisms and shall not be responsible for any failure, delay, restriction, or loss of access arising from third-party services, infrastructure, device limitations, operating system behaviour, network conditions, or changes imposed by external platforms.
9.1 You retain full ownership of all Content you create, upload, or store on the Platform.
9.2 You are solely responsible for:
(a) the legality, accuracy, and appropriateness of your Content;
(b) obtaining all necessary permissions, rights, and consents from any individuals appearing in or referenced by your Content; and
(c) ensuring that your Content does not infringe any third-party rights.
9.3 You must not upload, create, or share Content that:
(a) is unlawful, defamatory, abusive, or discriminatory;
(b) infringes intellectual property or privacy rights;
(c) contains malware or harmful code;
(d) promotes or facilitates self-harm or suicide; or
(e) violates these Terms or applicable law.
9.4 StoryMoments does not routinely review or monitor Content but reserves the right to remove, restrict, or disable access to Content that breaches these Terms or creates legal, technical, or reputational risk.
10.1 By uploading or creating Content, you grant StoryMoments a limited, non-exclusive, royalty-free, revocable licence to host, store, process, display, reproduce, and deliver your Content solely for the purpose of operating and providing the Platform.
10.2 This licence does not permit StoryMoments to sell, commercially exploit, or publicly distribute your Content outside the Platform.
10.3 The licence continues for as long as your Content remains stored on the Platform, subject to deletion, account closure, and applicable legal or backup retention obligations.
10.4 You may revoke this licence by deleting Content or closing your Account, subject to reasonable technical and legal constraints.
11.1 The Platform allows you to create, edit, update, re-record, and organise Content over time.
11.2 StoryMoments does not guarantee that:
(a) earlier versions of Content will be retained;
(b) deleted Content can be recovered; or
(c) any particular format, resolution, or feature will remain available.
11.3 Storage capacity, story limits, and usage allowances may vary depending on your Package or Subscription.
11.4 Content availability is subject to technical limitations, maintenance, upgrades, and circumstances beyond StoryMoments reasonable control.
11.5 Certain features of the Platform may use automated or AI-assisted processing, including previews, transcription, written letters, or compilation of books. These outputs are assistive in nature, may require user review, and do not involve advertising, behavioural profiling, or sale of Content.
12.1 The Platform may offer optional features that allow you to schedule, defer, or otherwise control when Content becomes accessible to Recipients, including scenarios where you are no longer able to manage your Account.
12.2 Where you correctly configure a supported future-access feature, Legacy access method, or Time Capsule, StoryMoments will use reasonable efforts to make the relevant Content accessible to the designated Recipient(s) in accordance with your selected settings.
12.3 Any delivery or access commitment is conditional upon:
(a) accurate and complete configuration by you;
(b) correct and up-to-date Recipient details;
(c) continued availability of the Platform;
(d) functioning third-party services, including email, notifications, deep linking, operating systems, devices, and app marketplaces; and
(e) your compliance with these Terms.
12.4 StoryMoments shall not be liable where access or delivery is prevented or delayed due to incorrect configuration, outdated Recipient information, Platform unavailability, third-party service failures, device limitations, or circumstances beyond StoryMoments reasonable control.
13.1 References to “long-term storage,” “built to last,” or similar language describe StoryMoments design intent and continuity planning only and do not constitute a guarantee of perpetual or indefinite availability.
13.2 Access to Content may be affected by:
(a) changes to technology or infrastructure;
(b) business continuity events;
(c) legal or regulatory requirements; or (d) circumstances beyond StoryMoments reasonable control.
13.3 In the event that StoryMoments ceases trading, restructures, or discontinues the Platform, reasonable efforts may be made to provide notice or access, but no obligation is assumed beyond what is required by law.
14.1 The website may offer fixed, one-time purchase Packages, commonly used for gifting.
14.2 Packages provide access to defined features, usage limits, or story allowances as described at the time of purchase.
14.3 Packages are not subscriptions and do not include ongoing access unless expressly stated.
14.4 Gifted Packages are subject to activation and usage requirements and may not be redeemed for cash.
14.5 StoryMoments reserves the right to modify Package offerings for future purchases without affecting existing active purchases.
15.1 Certain features of the Platform may be offered through app-based Subscriptions, which may include recurring access, usage allowances, or credits.
15.2 Subscriptions are billed on a recurring basis unless cancelled in accordance with the applicable app marketplace’s procedures.
15.3 Any free trial offered is limited to one per user unless otherwise stated and may be withdrawn or modified at any time.
15.4 Credits or allowances provided as part of a Subscription:
(a) have no cash value;
(b) are non-transferable; and
(c) may expire or reset at the end of each billing period unless otherwise stated.
15.5 Subscriptions purchased through third-party app marketplaces are governed by those platforms’ billing, cancellation, and refund rules.
16.2 Any promotional pricing, discounts, or offers are time-limited and subject to stated conditions.
16.3 References to “guarantees,” including money-back guarantees, apply only as expressly stated and do not extend beyond the specific terms described.
16.4 StoryMoments does not guarantee any particular outcome, emotional benefit, recipient response, or personal impact from use of the Platform.
17.1 A 30-day money-back guarantee applies only where expressly stated at the point of purchase is subject to fair use, and applies solely to eligible Packages purchased via the website.
17.2 The money-back guarantee does not apply to Subscriptions, purchases made through third-party app marketplaces, or bespoke Add-On Services once production or delivery has commenced.
17.3 Nothing in this section or in these Terms limits or excludes your statutory consumer rights under applicable UK law.
18.1 StoryMoments may offer optional Add-On Services, including professional videography, professional editing, and the creation of printed or digital books derived from your Content.
18.2 Add-On Services are bespoke in nature and may be subject to:
(a) separate scopes of work;
(b) delivery timelines;
(c) approval stages; and
(d) additional terms and fees.
18.3 StoryMoments does not guarantee availability of Add-On Services in all locations or at all times.
18.4 Where third-party contractors are engaged, StoryMoments does not act as an employer or agent of such providers.
20.1 You must use the Platform lawfully and in accordance with these Terms.
20.2 You must not:
(a) misuse or interfere with the Platform;
(b) attempt to circumvent security or usage limits;
(c) use the Platform for unlawful, harmful, or abusive purposes; or
(d) use the Platform in a way that could damage StoryMoments reputation or systems.
20.3 StoryMoments reserves the right to investigate and take appropriate action in response to misuse.
21.1 StoryMoments may suspend, restrict, or terminate access where use of the Platform conflicts with its intended purpose, creates legal, technical, reputational, or operational risk, or breaches these Terms or applicable law.
21.2 You may close your Account at any time using available account controls.
21.3 Upon termination or closure:
(a) access to Content may be restricted or removed;
(b) licences granted under these Terms will end, subject to legal and technical constraints; and
(c) certain clauses will survive termination.
21.4 Survival Clauses which by their nature should survive termination, including but not limited to clauses relating to intellectual property, licences, disclaimers, limitation of liability, indemnities, and governing law, shall survive termination or account closure.
22.1 Use of the Platform is subject to the Privacy Policy, which forms part of these Terms.
22.2 You confirm that you have the right to provide any personal data relating to third parties included in your Content.
22.3 StoryMoments processes personal data in accordance with applicable data protection laws.
23.1 The Platform is provided on an “as is” and “as available” basis.
23.2 StoryMoments does not warrant that the Platform will be uninterrupted, error-free, or meet your expectations.
23.3 StoryMoments does not warrant that Content will be delivered, accessed, or retained indefinitely.
The Platform relies on third-party services and infrastructure, including app marketplaces, hosting providers, cloud storage services, payment processors, notification services, and communications networks. StoryMoments does not control and is not responsible for the availability, performance, or security of such third-party services, and shall not be liable for any failure, interruption, or disruption arising from them.
24.1 Nothing in these Terms excludes liability that cannot be excluded under law.
24.2 Subject to clause 24.1, StoryMoments will not be liable for indirect, consequential, or emotional losses.
24.3 StoryMoments total liability is limited to the amount paid by you to StoryMoments in the 12 months preceding the claim.
24.4 You agree to indemnify StoryMoments against claims arising from your Content, misuse of the Platform, or breach of these Terms.
25.1 Governing Law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of England and Wales.
25.2 Good Faith Resolution
Before commencing any formal legal proceedings, you agree to first contact StoryMoments and attempt to resolve any dispute, concern, or complaint informally and in good faith. StoryMoments will use reasonable efforts to respond and seek a resolution within a reasonable period.
25.3 Mediation
If a dispute cannot be resolved through informal discussions, either party may propose that the dispute be referred to mediation. Unless otherwise agreed, mediation shall be conducted in England and Wales, in accordance with a recognised mediation procedure, and each party shall bear its own costs of mediation, with the mediator’s fees shared equally.
25.4 Court Proceedings
If the dispute is not resolved through mediation within a reasonable time, either party may bring proceedings before the courts ofEngland and Wales, which shall have exclusive jurisdiction.
25.5 Assignment
StoryMoments may assign, transfer, or subcontract its rights and obligations under these Terms to any third party, provided this does not reduce your statutory rights.
25.6 Severability
If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.
25.7 Entire Agreement
These Terms, together with any documents expressly incorporated by reference, constitute the entire agreement between you and StoryMoments regarding your use of the Platform and supersede all prior agreements, understandings, or representations.
25.8 Force Majeure
StoryMoments shall not be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from events, circumstances, or causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil unrest, labour disputes, governmental actions, failures of utilities or telecommunications networks, failures of hosting or cloud service providers, or interruptions to third-party platforms or infrastructure.
25.9 No Waiver
No failure or delay by StoryMoments to exercise any right, power, or remedy under these Terms shall operate as a waiver of that or any other right, power, or remedy, nor shall any single or partial exercise preclude any further exercise of that or any other right, power, or remedy.
